EPC Minimum Standards 2026: Which Properties Are At Risk?
MEES regulations are tightening. If your rental properties don't meet the new minimum EPC rating, you face fines of up to £30,000 per property. Here's what you need to know.
Current MEES Requirements
The Minimum Energy Efficiency Standards (MEES) regulations set the minimum EPC rating for rental properties in England and Wales. The requirements are being phased in:

Penalties for Non-Compliance
- Letting a non-compliant property: up to £30,000 fine
- Providing false or misleading information on EPC exemption register: up to £5,000
- Failure to comply with compliance notice: up to £5,000
- Multiple properties: fines apply PER PROPERTY
For a landlord with 10 properties rated Band D, the total fine exposure is up to £300,000.

Exemptions
You may be exempt from MEES if:
- All relevant improvements have been made and the property still doesn't reach Band C (cost cap exemption: £10,000 including VAT)
- A third-party consent is required and has been refused (e.g., planning permission, freeholder consent)
- An independent surveyor confirms improvements would reduce the property's value by more than 5%
Exemptions last 5 years and must be registered on the PRS Exemptions Register.

- Get new EPC assessments for properties with expired certificates (valid 10 years)
